1. Purpose

These Terms of Use govern access to and use of the tourrio330.com website, as well as the online booking of the guided tour of the Rocinha favela offered by Tour Rio 330. By booking a tour on this site, you accept these Terms of Use without reservation.

2. Site publisher

The tourrio330.com website and its associated booking service are published by Chloé Gamain, operating Tour Rio 330 from Rio de Janeiro, Brazil. Contact: contact@tourrio330.com.

3. Description of the service

Tour Rio 330 offers a walking and moto-taxi guided tour of the Rocinha favela in Rio de Janeiro, led by guides born and raised there. The service is available in French, English, Portuguese and Spanish.

4. Booking and payment

• Booking is done exclusively online, through the website's form.
• The price is fixed in advance and displayed in Brazilian reais (BRL) before payment; for payments made with a foreign card, the final amount may vary slightly depending on the exchange rate and fees applied by your bank.
• Payment is processed by a secure third-party provider (Stripe); Tour Rio 330 does not store any banking data.
• A confirmation is sent by email as soon as payment is completed, followed by a reminder with practical information 48 hours before the visit.

5. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services to be provided on a specific date. Booking a tour for a set date and time falls under this exception: the client therefore does not benefit from a withdrawal period after payment. The cancellation terms that still apply are detailed in our Cancellation Policy.

6. Client obligations

• Be of legal age and legally capable of entering into a contract, or book under the responsibility of a legal guardian for any minor participant.
• Arrive on time at the indicated meeting point (São Conrado metro station).
• Behave respectfully towards the guides and residents of Rocinha throughout the visit.
• Do not photograph residents or their homes without their explicit consent.
• Wear comfortable clothing suited to an outdoor walk.

7. Physical fitness

The tour involves prolonged walking on uneven terrain as well as a moto-taxi ride. It is the client's responsibility to ensure they are physically fit to take part, and to mention before booking any medical condition or mobility issue that may require an accommodation.

8. Cancellation and changes

The conditions for cancelling or changing a booking are detailed in our Cancellation Policy, which forms an integral part of these Terms of Use.

9. Liability

The tour partly takes place outdoors and includes a moto-taxi ride. As with any activity of this kind, the client takes part with knowledge of local traffic and terrain conditions. We recommend clients take out travel insurance covering this type of activity. Tour Rio 330 does everything possible to ensure the safety of the visit, notably through experienced guides who know the neighborhood thoroughly. Except in the case of proven fault on our part, Tour Rio 330 cannot be held liable for indirect damages, nor for the consequences of a force majeure event (weather conditions, civil unrest, decisions by local authorities) preventing the tour from taking place as planned.

10. Intellectual property

All texts, photographs and graphic elements on the tourrio330.com website are the property of Tour Rio 330 and may not be reproduced without prior authorization.

11. Governing law and dispute resolution

These Terms of Use are governed by Brazilian law, the place where the service is performed, without depriving a client residing in the European Union of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute, an amicable solution will be sought first through our customer service, by writing to contact@tourrio330.com. In accordance with Article L.616-1 of the French Consumer Code, clients residing in France may also make free use of a consumer mediator; the relevant mediator's contact details are provided on request from our customer service.

12. Changes to these Terms

Tour Rio 330 may amend these Terms of Use at any time; the version applicable to your booking is the one in force on the date of that booking. The update date at the top of this page is refreshed with each change.

13. Severability

Should any clause of these Terms of Use be held illegal, void or unenforceable, the remaining clauses shall remain in full force and effect.
